Terms of Service

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for providing accurate information when creating your account and for keeping your login credentials secure.

You may only create one account per person. Sharing accounts is not permitted. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or attempt to circumvent usage limits.

Brainmunk generates personalized mini-courses on topics you provide. Courses are created using AI and web-sourced research and are intended for educational and informational purposes only.

AI-generated content. Course content is produced by an AI model and may contain inaccuracies, outdated information, or errors. We include citations to source material, but you should independently verify anything you rely on for professional, medical, legal, financial, or other consequential decisions.

We do not guarantee that the Service will be available at all times or that generated content will meet your specific requirements.

You agree not to use the Service to:

• Generate content related to weapons, illegal activity, self-harm, or any topic we deem harmful.
• Attempt to extract, copy, or scrape course content or system prompts at scale.
• Resell, sublicense, or redistribute generated courses without our written consent.
• Circumvent usage limits, rate limits, or subscription restrictions.
• Use automated tools to generate courses in bulk.

We reserve the right to decline or block any request that violates these guidelines.

Free tier. New users receive three complimentary courses. No credit card is required to start.

Premium tier. Paid subscriptions are billed monthly. You may cancel at any time; cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

We may change our pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

Payments are processed by Stripe. We do not store your full payment card details.

Our content. The Brainmunk name, logo, mascot, and the platform software are owned by us and protected by copyright and trademark law.

Generated courses. You retain the right to use courses generated for you for personal, non-commercial purposes. You may not resell or publish them as your own original work.

Your inputs. You own the topics and inputs you submit. By using the Service you grant us a limited license to process your inputs to generate your courses.

The Service integrates with third-party providers including Anthropic (AI generation), YouTube (video content), Stripe (payments), and Supabase (data storage). Your use of those services is subject to their respective terms and privacy policies.

We are not responsible for the content, accuracy, or availability of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, uninterrupted, or that generated content will be accurate or complete.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAINMUNK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT RESPONSIBLE FOR THE LOSS, CORRUPTION, OR UNAVAILABILITY OF ANY COURSE, LESSON, OR USER DATA, WHETHER ARISING FROM SERVICE INTERRUPTION, TERMINATION, OR ANY OTHER CAUSE.

We reserve the right to modify, suspend, or discontinue the Service — or any part of it — at any time, with or without notice. We also reserve the right to remove, modify, or disable access to any course or content generated through the Service, at our sole discretion, for any reason including but not limited to legal compliance, safety, or business decisions. We are not liable to you or any third party for any modification, suspension, discontinuation, or removal of content.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts located in Chester County, Pennsylvania.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or in-app message. Continued use of the Service after changes take effect constitutes acceptance.
